This privacy policydescribes how SecureData collects, shares, secures, and uses the personalinformation you provide on our website www.securedata.com, mobile app, andthrough our Services. The use of information collected through our serviceshall be limited to the purpose of providing the service for which the clienthas engaged SecureData. It also describes the choices available to youregarding our use of your personal information and how you can access andupdate this information.

At SecureData, we greatly respect ourclients’ privacy. We were the first data recovery provider to meet SSAE 18 TypeII audit standards, and over the years, we have built a strong reputation forour commitment to security and transparency.

We provide a detailed overview of ourpractices to help you use our website. Contact our customer service departmentif you have any questions regarding the terms listed below. The use ofinformation collected through our service shall be limited to the purpose ofproviding the service for which the client has engaged SecureData.

EU-U.S. Data Privacy Framework and Swiss-U.S. Data PrivacyFramework

SecureData complies with the EU-U.S.Data Privacy Framework and the Swiss-U.S. Data Privacy Framework as set forthby the U.S. Department of Commerce.  SecureData has certified to the U.S.Department of Commerce that it adheres to the EU-U.S. Data Privacy FrameworkPrinciples with regard to the processing of personal data received from theEuropean Union in reliance on the EU-U.S. DPF.  SecureData has certifiedto the U.S. Department of Commerce that it adheres to the Swiss-U.S. DataPrivacy Framework Principles with regard to the processing of personal datareceived from Switzerland.  If there is any conflict between the terms inthis privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPFPrinciples, the Principles shall govern.  To learn more about the DataPrivacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/.

SecureData is responsible for the processing of personaldata it receives, under the DPF, and subsequently transfers to a third partyacting as an agent on its behalf. SecureData complies with the DPF Principlesfor all onward transfers of personal data from the EU and Switzerland,including the onward transfer liability provisions.

The Federal Trade Commission has jurisdiction overSecureData’s compliance with the EU-U.S. DPF and Swiss-U.S. DPF.  In certainsituations, SecureData may be required to disclose personal data in response tolawful requests by public authorities, including to meet national security orlaw enforcement requirements.

In compliance with theEU-U.S. DPF and the Swiss-U.S. DPF, SecureData commits to refer unresolvedcomplaints concerning our handling of personal data received in reliance on theEU-U.S. DPF and the Swiss-U.S. DPF to TRUSTe, an alternative dispute resolutionprovider based in the United States.  If you do not receive timelyacknowledgment of your DPF Principles-related complaint from us, or if we havenot addressed your DPF Principles-related complaint to your satisfaction,please visit https://feedback-form.truste.com/watchdog/request for more information orto file a complaint.  These dispute resolution services are provided at nocost to you.

For complaints regarding DPFcompliance not resolved by any of the other DPF mechanisms, you havethe possibility, under certain conditions, to invoke binding arbitration.Further information can be found on the official DPF website.

 

Collecting and Using PersonalInformation

SecureData collects basic informationfor internal use. This includes but is not limited to phone numbers andaddresses entered into our online evaluation form or information collected overthe phone when you call our customer service department. We also collect yourfirst and last name, email address, and phone number when you send us a requestregarding our services. We collect credit card information to make payments forinvoices using our payment processor and photos for job applications on thesite. When you use our media services, we keep your information strictlyconfidential.

We only use your information for theprimary purpose of contacting you, creating your account with us, assessingyour needs and responding to your customer service requests.

Information Disclosure Guidelines

We will share your personalinformation with third parties only in the ways described in this privacypolicy. We do not sell your personal information to third parties.

SecureData does not share any personalor corporate information except for the purposes of providing requestedproducts and services. In the event that we need to share personallyidentifiable information with equipment manufacturers or other third parties,we will request your permission prior to doing so.

We may share your information withthird parties who provide services on our behalf to help with our businessactivities. These companies are authorized to use your personal informationonly as necessary to provide these services to us.

These services may include:

  • Fulfilling orders and delivering     packages

SecureData may be obligated to respondto subpoenas or other legal processes. We reserve the right to shareinformation in order to prevent illegal activities or to aid in theinvestigation and prosecution of illegal activities as required by law and whenwe believe in good faith that disclosure is necessary to protect our rights,protect your safety or the safety of others. We also reserve the right to usecollected information to defend against lawsuits, to establish fault or forother legal reasons not explicitly listed in these terms.

If SecureData is involved in a merger,acquisition, or sale of all or a portion of its assets, you will be notifiedvia email and/or a prominent notice on our website of any change in ownershipor uses of your personal information, as well as any choices you may haveregarding your personal information.

User Access and Choice

Upon request, SecureData will provideyou with information about whether we hold or process on behalf of a thirdparty any of your personal information. To request this information pleaseemail us at legal@securedata.com.

If your personal information changes,or if you no longer desire our service, you may correct, update, or delete itby emailing our Customer Support at customercare@securedata.com or by contacting us throughtelephone or postal mail at the contact information listed below. We will retain your information for aslong as your account is active or as needed to provide you services. We willretain and use your information as necessary to comply with our legalobligations, resolve disputes, and enforce our agreements.

Security

The security of your personalinformation is important to us. When you enter sensitive information (such aslogin credentials and credit card information) on our forms, we encrypt thetransmission of that information using secure socket layer (SSL) Technology.

We follow generally accepted standardsto protect the personal information submitted to us, both during transmissionand once we receive it. No method of transmission over the Internet, or methodof electronic storage, is 100% secure, therefore we cannot guarantee itsabsolute security. Tracking Technologies

As is true of most websites, we gathercertain information automatically and store it in log files. We do not link this automatically-collected data to otherinformation we collect about you.

SecureData and our third-party partners(marketing partners), affiliates, or analytics or service providers (onlinecustomer support provider) use technologies such as cookies, beacons, tags, andscripts. These technologies are used in analyzing trends, administering thesite, tracking users’ movements around the site, and gathering demographicinformation about our user base as a whole. We may receive reports based on theuse of these technologies by these companies on an individual as well asaggregated basis.

We partner with a third party toeither display advertising on our website or to manage our advertising on othersites. Our third-party partner may use technologies such as cookies to gatherinformation about your activities on this site and other sites in order toprovide you advertising based upon your browsing activities and interests. We will offer individualsthe opportunity to choose (opt-out) whether their personal information is (a)to be disclosed to a non-agent third party, or (b) to be used for a purposeother than the purpose for which it was originally collected or subsequentlyauthorized by the individual. We will provide individuals with reasonablemechanisms to exercise their choices.

When you download and use ourservices, we automatically collect information on the type of device you use,operating system version, and the device identifier (or “UDID”).

We send you push notifications fromtime-to-time in order to update you about any events or promotions that we maybe running. If you no longer wish to receive these types of communications, youmay turn them off at the device level. To ensure you receive propernotifications, we will need to collect certain information about your devicesuch as operating system and user identification information.

We use mobile analytics software toallow us to better understand the functionality of our mobile software on yourphone. This software may record information such as how often you use theapplication, the events that occur within the application, aggregated usage,performance data, and from where the application was downloaded. We do not linkthe information we store within the analytics software to any personallyidentifiable information you submit within the mobile application.

Limitation of Liability

By using our services, you acknowledgethat any item shipped to our offices (hereafter referred to as “media”) may bedamaged during shipment and/or lost prior to receipt. You agree that SecureDatacannot be held liable for any damage or loss that occurs before we receive yourmedia.

At SecureData, we take care to protectour clients’ media and always use safe techniques to recover files. We treatphysically damaged media in a certified Class 10 ISO 4 Cleanroom and holdcertifications from many major manufacturers that demonstrate our commitment toproviding consistently safe services. However, due to the sensitive nature ofdata recovery and media repair, we cannot accept liability for any damage thatmay occur to your equipment/data/media at our facilities.

SecureData cannot be held liable forany indirect media damage or data loss. You agree that SecureData cannot beheld liable for any damages that occur due to any virus, Trojan horse, or othermalicious application. The total liability of SecureData to a customer cannotexceed the total cost of services.

To safely treat your media, we mayneed to ship your hard drive to our offsite facility or corporate headquarters.We reserve the right to ship your hard drive as needed in order to complete ourservices. We cannot accept payments in excess of $3,000.00 USD via credit card.SecureData reserves the right to dispose of external hard drive enclosures orother components during our diagnostics process in order to ensure fastturnaround times.

SecureData is not responsible for lossof profit or any other damages incurred by our customers during the data recoveryprocess or return shipment. SecureData will also not be held responsible orliable for any damage to desktop computers, servers, laptops, or any otherhardware.

Information Related to Data Collectedfor our Clients

SecureData collects information underthe direction of its clients and has no direct relationship with theindividuals whose personal data it processes. If you are a customer of one ofour clients and would no longer like to be contacted by one of our clients thatuse our service, please contact the client that you interact with directly. Wemay transfer personal information to companies that help us provide ourservice. Transfers to subsequent third parties are covered by the serviceagreements with our clients.

An individual who seeks access, or whoseeks to correct, amend, or delete inaccurate data should direct his query tothe SecureData’s client (the data controller). If requested to access or removedata we will respond within 30 days.

We will retain personal data weprocess on behalf of our clients for as long as needed to provide services toour clients. SecureData will retain this personal information as necessary tocomply with our legal obligations, resolve disputes, and enforce ouragreements.

Confidentiality and Security

SecureData limits access to ourcustomers’ information to our staff members who need said information in orderto provide requested services to you and your business. We may also shareinformation at our discretion with reputable equipment manufacturers in the courseof providing our services. These third-party service providers (such asmanufacturers) are authorized to use your data diagnostics only as necessary toprovide these services to us.

SecureData may sign confidentialityagreements if requested; the terms of those agreements may reinforce thisagreement but will not supersede this agreement unless they contain an explicitstatement to this effect. We maintain a strict non-disclosure agreement, andall of our employees and vendors comply with this agreement.

You may sign-up to receive emails ornewsletters or other communications from us. If you would like to discontinuereceiving this information, you may update your email preferences by using the“Unsubscribe” link found in emails we send to you or by contacting us at legal@securedata.com.

Links to Third-Party Sites

Our site includes links to otherwebsites whose privacy practices may differ from those of SecureData. If yousubmit personal information to any of those sites, your information is governedby their privacy policies. We encourage you to carefully read the privacypolicy of any website you visit.

We display personal testimonials ofsatisfied customers on our site in addition to other endorsements. With yourconsent, we may post your testimonial along with your name. If you wish toupdate or delete your testimonial, you can contact us at legal@securedata.com.

Blogs

Our blog is also managed by athird-party application that may require you to register to post a comment. Wedo not have access or control of the information posted to the blog. You willneed to contact or login into the third-party application if you want thepersonal information that was posted to the comments section removed. Social Media Widgets

Our website includes social mediafeatures, such as Facebook and Twitter buttons and Widgets including the Sharebutton and interactive mini-programs that run on our site. These features maycollect your IP address, which page you are visiting on our site, and may set acookie to enable the feature to function properly. Social media features andWidgets are either hosted by a third party or hosted directly on our site. Yourinteractions with these features are governed by the privacy policy of thecompany providing it.

Changes to this Privacy Policy

SecureData may apply changes orupdates to this policy as needed. Most changes are for additional clarity andwill not affect the quality of our services. We will notify you aboutsignificant changes by placing a notice on our website or by sending you anemail; however, we will provide such notice prior to the change becomingeffective.
